APPLICATION FOR THE CANCELLATION OF BAIL GRANTED TO THE ACCUSED, S. KHAN  UNDER SECTION 439(2), CRIMINAL PROCEDURE CODE, 1973 ON BEHALF OF SH. MEHTAB, THE FATHER OF THE MINOR VICTIM GIRL

  1. That the Daughter of the applicant namely Ms. XX was kidnapped  by the accused, S. Khan, Son of AB on 13.02.22. She  is 16 years old and studies  in class 12th. An FIR no. 228/22 was got registered by the wife of the applicant, Mrs. X on 13.02.2022 at PS. Vasant Vihar, New Delhi. The copy of the said FIR no. 228/22 is annexed herewith as ANNEXURE-A
  2. That in the kidnapping of applicant’s daughter, S. Khan was being supported by Kadir, S/O XX, who is still threatening the applicant’s daughter.
  3. That on 29.02.2022, applicant filed a writ petition No. W.P.(CRL)XX under Article 226 of the Constitution of India for his 16 years old minor daughter who was missing since 13.02.2016. The internet copy of the final order dated 23.03.2022 of the Delhi High Court are annexed herewith as ANNEXURE-B (Colly)
  4. That on 15.03.2022, Police recovered applicant’s daughter along with accused S.Khan from  U.P. The accused was produced on 16.03.2022 before the Hon’ble court of sh. H. Singh, MM, Patiala House Courts, New Delhi and was sent to judicial custody.
  5. Accused S. Khan is the father of four children and a widower. He always horrified applicant’s minor daughter and kept her under constant fear. When he kidnapped his daughter he specifically instructed her with threat that in case of her recovery and his arrest by the police she must say that she married with him out of her free will and the same thing was stated by the minor girl in his first statement of 164 of Cr.P.C.
  6. On 12.06.2022, the accused was released on bail by the Hon’ble court of Sh. XX,Judge, MACT functioning as vacation court during the period of summer vacation on the very light surety amount of Rs 20,000.
  7.  It is surprising that despite the keen observation of the Hon’ble High Court Of Delhi regarding the situation of  the victim girl stating  that “ the missing girl even today submits she is under the constant fear of respondent no.4 (accused.), the Hon’ble vacation court granted bail to the accused.
  8. That it is pertinent to mention here that the all allegations against accused are very grave and serious attracting sections of kidnapping, rape and forgery of Indian Penal Code alongwith the POCSO Act.
  9. The minor girl at his tender age  of 16 years were interrogated by the Hon’ble High Court and  the investigating agency was directed  to record the statement of the girl afresh and also to produce before the Hon’ble Magistrate at Patiala House Court for the recording of the statement of the victim girl again.
  10. In compliance of the direction of the Hon’ble High Court of Delhi, the victim girl  went to the PS. Vasant Vihar and these facts were stated by the girl in writing on 23.03.2022. Thereafter the victim girl was brought to Patiala House Court where she had given her statement U/s. 164 of Cr.P.C afresh without fear and pressure of the accused and his associates.
  11. That Kadir who supported main accused S. Khan were continuously threatening applicant and his family to face dire consequence if  they would mention their names in this case. They were already living under fear due to their threatening and the police was not taking any action against the co-accused  as the IO of the case, Mr. Y had taken huge money as bribe from the family of Shahadat and he has misguided the Hon’ble Vacation court supporting the case of the accused at the time of the hearing of the bail application. IO also did not inform the complainant about the hearing of this bail application in connivance with the accused and his family.  The receiving copy of the complaint given to the police addressed to the S.H.O. P.S. Vasant Vihar dated 14.06.2022   is annexed herewith as ANNEXURE-C
  12. The investigation is still going on and the charge sheet has not been filed in this case. The release of the accused is going to adversely affect the investigation as he has already managed the IO of the case and the minor girl is under pressure and constant threat on the side of the accused which will affect the fair trial of  this case. There is every possibility of the repetition of the same act of kidnapping and rape of the minor girl by the accused and the protection of the family is on stake.

PRAYER

It is therefore, respectfully prayed that considering the above mentioned facts, this Hon’ble Court may graciously be pleased to cancel the bail of the accused , S. Khan and pass order for his arrest and to commit him to custody till the completion of the investigation of the case and recording of the statement of the minor victim girl before the court  in the interest of justice.

Any other appropriate relief which this Hon’ble Court may deem fit and proper be also granted.
